Today, the ninth session of the Mejlis of Turkmenistan of the seventh convocation was held, where a number of bills were considered and adopted, developed in accordance with the priorities of state policy and a comprehensive program for modernising the country's legal framework, guided by the valuable advice and tasks set by the President of Turkmenistan Serdar Berdimuhamedov and the National Leader of the Turkmen people, Chairman of the Halk Maslahaty of Turkmenistan Gurbanguly Berdimuhamedov on further modernisation of national legislation in accordance with the requirements of the time.
Representatives of a number of relevant ministries, departments, and the media were invited to the session of the Mejlis. The adopted laws were developed based on the results of a preliminary discussion of their drafts.
Among the first to be submitted for consideration by parliamentarians was the bill «On the approval and entry into force of the Civil Code of Turkmenistan» (new edition).
As noted, over more than a quarter of a century that have passed since the adoption of the Civil Code of Turkmenistan, our independent, neutral country has experienced several periods of revival in its rapid development and has taken a worthy place among the sovereign states of the world. The active and rapid integration of the country into the international space in the political, economic, legal and other spheres, the development of a market economy, entrepreneurship and business, the expansion of human rights and freedoms have revealed the need to improve the Code.
In this regard, the draft Code was developed by specialists from ministries and departments together with experts from Germany, based on the tasks set by the President of Turkmenistan Arkadagly Hero Serdar in his substantive programmatic speech at the first meeting of the Mejlis of Turkmenistan of the seventh convocation to improve the legislative framework regulating civil-legal relations in the country, and to introduce into it norms related to international private law.
The speakers noted that in order to create a reliable legal basis for charitable activities carried out in accordance with the humane policy of the National Leader of the Turkmen people, Chairman of the Halk Maslahaty of Turkmenistan Hero Arkadag and President Arkadagly Hero Serdar, a chapter regulating relations related to charitable activities, as well as a part on international private law applicable to civil law relations involving foreign citizens or foreign legal entities, or other foreign elements, have been introduced into the Civil Code.
The terms used in the Code are defined in accordance with the practice of our national legislation, and their content is fully explained. Also, the names of sections and chapters of the Code, the structure of articles have been brought into line with the Law of Turkmenistan «On Legal Acts», and the current provisions of the Code have been modernized in accordance with the Constitution of Turkmenistan and current laws.
The adoption of the Civil Code of Turkmenistan in a new edition, prepared in accordance with the Constitution of Turkmenistan and generally recognized norms of international law, will play an important role in improving the legislative framework of civil-legal relations in the country, strengthening the legal foundations applied to civil-legal relations with the participation of foreign persons or containing a foreign element.
In accordance with the agenda of the Mejlis, the deputies considered the draft Law of Turkmenistan «On the Unified State Register of Voters», developed by the Mejlis of Turkmenistan jointly with the Central Commission for Holding Elections and Referendums in Turkmenistan. The main objectives of the draft law are the creation of a centralized digital information system designed to store, process and use data, ensure state registration of citizens of Turkmenistan entitled to vote, containing information provided for in the law, and ensure the correctness and accuracy of registration, compliance with the electoral rights of citizens, the reliability and security of the data of the State Register.
The adoption of this law will increase the efficiency of work on the introduction of a digital system in electoral processes at the modern level in accordance with the «Concept for the Development of the Digital Economy in Turkmenistan in 2019-2025» and the «State Program for the Development of the Digital Economy in Turkmenistan for 2021-2025».
The deputies also reviewed the draft laws of Turkmenistan «On Amendments to the Law of Turkmenistan» «On the Internal Affairs Bodies of Turkmenistan», «On Amendments to the Customs Code of Turkmenistan», «On Amendments to the Law of Turkmenistan» «On the Customs Service».
The draft legislative acts submitted for consideration at the next meeting of the Mejlis of Turkmenistan of the seventh convocation were unanimously approved and adopted.
In conclusion, the deputies expressed confidence that the above-mentioned legal documents, supplementing the current legislative system of independent neutral Turkmenistan, will provide the necessary positive conditions for the further successful implementation of large-scale socio-economic and democratic reforms under the leadership of President Serdar Berdimuhamedov aimed at the progressive development of various spheres of life in the Fatherland.
The parliamentarians expressed their sincere gratitude to Hero Arkadag and President Arkadagly Hero Serdar for the support provided to the Mejlis of Turkmenistan in improving the national legislation of the country and the opportunities provided, assuring that, guided by valuable advice and instructions on further strengthening the legislative framework of the state in accordance with the requirements of the time, along with legislative activity, they will make every effort to explain the significance of the laws being adopted, as well as the glorious 30th anniversary of Turkmenistan's permanent neutrality and the International Year of Peace and Trust.
